Prosecutors should work impartially: PM Deuba


Prime Minister Sher Bahadur Deuba has said the attorneys need to work by staying away from any pressure and interference. The agency that abides by country’s law and has the role to encourage others for it, should execute work impartially, he stressed.

PM Deuba said it while addressing the fourth national conference of the attorneys in the federal capital on Friday. “The office of the attorney is a significant body to promote rule of law,” he reminded, adding, “They must not take side with any party of the case.”

According to him, it is imperative to build the professional capacity of prosecutors for prosecution, for which, the government is committed to extending support.

On the occasion, Acting Chief Justice Hari Krishna Karki said the investigation and prosecution by the attorneys must be objective and scientific. “Investigation and prosecution must go in consistence,” he said, stressing, “New sorts of criminal offenses have emerged of late. Traditional norms and approach do not suffice for effective investigation.”

Uniformity in the implementation of Civil and Criminal Codes is also the need of hour, according to him.

Home Minister Balkrishna Khand said prosecutors need to be equipped and their profession modernized. Development of technologically capable human resources is necessary as per time, Khand underlined.

Moreover, Nepal Bar Association’s Chairperson Gopal Krishna Ghimire viewed settlement of any case could be successful if the prosecution is forwarded by able prosecutor. In the developed countries, the prosecutors have 90 percent success. “Reform in prosecution, legal practice and courts is mandatory for the reform in entire judiciary,” he viewed.

The conference would run till December 25. The main objective of the conference, began under the slogan, “Effectiveness of Criminal Justice: Guarantee of Rule of Law”, is to identify the situation of the implementation of new laws including Civil Code, difficulties in its implementation and identifying areas of improvement based on challenges.

Similarly, reviewing the implementation of third five-year strategic plan of the office of the Attorney General, taking initiatives for effectiveness, institutional reforms of the Office of the Attorney General, developing physical infrastructure and providing guidance for future plan are also the objectives.

Four hundred sixty-five prosecutors have been participating in the conference.

Chief Attorney Khamma Bahadur Khati said the conference was expected to prepare bases for formulating necessary laws on terms and condition for professional development and institutional strengthening of prosecutors. Increasing effectiveness in the specialization in defense of the case on behalf of government and pleading and coordination are the objectives, he added. (RSS)
